The principal means by which the state is effective is through coercion?interference with your property, or the threat of such interference. It has no other means of "enforcement". The entire concept of the state is antithetical to voluntary interaction between normal people of good cheer, which interaction is based on the concept of mutual benefit. In fact, the state cannot possibly serve as government. How is it possible to protect property by interfering with it?

Seen from that perspective, the actions of both Microsoft and Apple look like a case of severe anal-cranial inversion. It's the moral equivalent of appealing to the biggest, baddest gangster for protection against the hordes of other petty thugs and thieves.

Microsoft has commandeered the patent system as part of their strategy to dominate the market. Maybe they have learned some valuable lessons about how to do that without running afoul of the anti-trust laws, but all that does is make them legal. It doesn't make them right.

I understand that Apple has to play to stay in the game. But as they've learned in the past (or should have), going head to head with Microsoft in the legal arena on the subject of intellectual property comes down to a battle of legal budgets. The patent system is a racket, legitimized by the patina of pseudo-respectability it derives from its coercive authority. I don't envy Apple; they're dealing with gangsters. Principle has nothing to do with it.
