Just how...

"This is what due diligence is supposed to avoid."

does any company perform "due diligence" when it comes to
software patents? Patents filed may never be approved, and
patents granted may not survive a legal challenge.

"In the end, the lawyers are, again, the only winners."

And companies with deep pockets that can drag out cases,
engage in frivolous lawsuits, file hundreds of crap patents to use
against competition, threaten to use their patents against
competition with FUD, etc.

The patent system is a disgrace, extending it to software is
destructive.
