Why?

'...when they are small companies growing they're all "no software patents"'

When has Apple ever publicly declared that?

'When they're at the top of the pile its always "protect us protect us we need patents"'

When has Apple ever publicly declared that?

"I have no sympathy for Apple if Apple don't come out against software patents in Europe."

While I'm sure Steve Jobs is waiting for your call offering support, I don't think Apple is about to change corporate policy on your opinion.

Apple has generally use the courts to protect what it sees as its IP, it has never gone out of its way to make money by suing someone else for use of Apple IP e.g. the eMachines case only wanted them to stop making iMac rip-offs, not pay zillions in compensation.

Having said that, I'm interested to see if such a vague claim can be made to stick.
