The genie is already out of the bottle
While I agree totally that this behavior should be made illegal, I am afraid it is too late. The telephone version of spammers will now have this technology and will use it to bypass do not call legislation. Perhaps a few will be prosecuted but there will be no stopping this avalanch once it starts.

Now if the telcos can stop this technologically, as someone stated above, then that would be a far, far better solution than legislation. I believe customer pressure will drive these companies to resolve the issue, if they can.
