Right, and end user and content provider are paying for that use.

When consumers (end users) sign up for services they are presented with service options, and the cost for such service.

When content providers sign up for services, they too are presented the same information, SLAs, specific service agreements, metering, etc., and the cost associated with such services.

So, specifics are set. Prices are set, service levels, bandwidth agreements, etc., are set. And the problem is?

If an entity you have a contract with exceeds the agreed usage, that contract has additional costs itemized. That exists today.

At the consumer level, you sold them on specific services - ergo you provide such, up to (and only up to) the level you promised for the price (re: if DSL is $x for 256K, then the service is capped at 256K for $x). That exists today.

So again, if you're saying you need more money to invest, then collect them with the tools you have today. I mean, you obviously have the data pulled from somewhere to make these assertions, and I don't doubt that. If you have access to that data, you have the information to collect the specific additional costs, today, based on that data.

In other words, the more you vouch for the accuracy of the data presented here to make these predictions, the easier it is for you or any ISP for that matter, collect fees due you based on existing legal service agreements. That is the capital for you to reinvest for the future.

If one is saying that these fees aren't enough, then as with all contracts, they have a term. You have every right to renegotiate at the end of that term to account for any inequities that may have existed.
