RE: New York City subpoenas creator of text messaging code
As I understand it, these text messages were broadcasts NOT private. If so, the only privacy issue is the list of those who received the messages not the content nor the sender.

Yelling "fire" in a crowd is not protect speech. Texting "join the riot on 5th and Broadway" to a mob is also not protected.
