So why...
...would text messages receive less protection than voice calls? The robbers were stupid (wireless communications can be intercepted in any number of ways), but if it's illegal to tap a voice call without a warrant, then it should also be illegal for providers to hand over text messages without a warrant as well.

The other alternative would be to allow police to intercept communications at will; after all, a literal reading of the Fourth Amendment says nothing about people's right to secure communications (or even confidentiality). I would not be in favor of such an interpretation (and don't think Madison would have been either), but I'm also not a strict constructionist.
