Breathing air or listening to the radio. You're not physically on their property, so I'm not so sure it's trespassing.
Starbucks and Panera provide free wi-fi, if I connect from my house is that illegal or just against their policy? If I buy a coffee, how long can I use their wi-fi? Can I bring the coffee home and connect from there? What if it's a mile away and I have a 4 foot dish on my roof to connect to their network?
Now I'd say if you're malicious and trying to crack someones network that's a whole another issue. Even just to use their wi-fi.
