No, you still have to seek out or acquire these images. You have to traffick in it. The same goes for seeing your neighbor's kid naked through the window. From across the street, it would not be a crime.

Going on the property and peeking through the slits in the blinds IS a crime. The intent and activity surrounding the act are what defines the SPIRIT of the law.

If your "good friend" never harmed a child, what can you say of the people who supplied those materials to him? Did he recieved an indemnity form indicating that all children raped in these images were not done by the seller? Did the seller/passer of this material recieve a legal document indicating that the children raped were also not victims of them?

Who do you hold liable? If nothing else, possession, copying and trafficking of kiddie porn is tampering with crime scene evidence. nothing at all has to do with the "simple viewing".

Should your good friend who looks at naked children be allowed to supervise a playground? Play Santa at the mall? Be a janitor at an elementary school? play with your kids?
