Yes, the WiFi is not to blame but since it was (presumably) open, then anyone within range would be on the same network as the computers in the physical house and would be seen to the Internet with that same IP address. That means that it could have been anyone with a WiFi receiver that could have sent the message.

Of course, as others have indicated, the CD is a different issue-but, the story did not indicate if it had the defendant's fingerprints on it so jut becuause it was in the "area" of the defendant's computer does not mean it was his.
