Copyrights are better suited for software than patents.

The thing about patents may not be a good analogy, but to put this simple, I can't make a patent of going from one building to another building in a different way that they've never attempted, since all I've done would sound way too obvious. Another example, in Algebra, I can't patent (x - 1)(x + 1) = 0, because it's just a simple quadratic equation.

In general, if I have invented an ideal in software, I would just copywrite it instead of patenting my "virtual" invention...
