All patents is a bit over board
Patents were intended to protect actual inventions not non-physical ideas. The mechanism that protects non-physical ideas is a copyright. The problem is that copyrights prevent exact duplication. While patents are a bit more broad in their protection as they protect the design of the physical product. Basically software falls under the copyright area rather than the physical invention area. So I agree that patents shouldn't apply to software but they should apply to hardware.
