As I understand, It's also already illegal. I don't have time to look up the precedents at the moment, so I'm just being a broken record. IF my understanding is correct, someone who pulls that off could end up on the defense of a class action law suit, both from ISP customers and the sites that were intentionally restricted a/o denied after refusing to pay a fee.

On rules of the road, giving larger traffic more bandwidth may have to happen to keep the pipes flowing. I can certainly see how this can be abused, though. I know there's plenty of unlit fiber, but for some reason I don't expect to see them opening too many new pipes any time soon; Like the diamond industry, artificially limiting supply creates the appearance to the demand of justified prices. I'm sure they have a formula somewhere that defines how to control their bandwidth per customer for given cost.
