Congress as not declared war on Iraq ...
... instead, Congress gave the President the authority he already had (under Article II) to act as Commander-in-Chief. Without a declaration of War, the President has no power to declare Marshal Law. FISA was passed in 1978 precisely to keey the President from doing what the then-president did between 1975 and 1978, which is what President Bush is doing now -- and end run around the courts and violating the Fourth Amendment in the process. He is doing htis because he knows that he cannot get a legal search warrant without probable cause.
