Many laws have been passed and signed that the president has stated at the time was unconstitutional and did not apply. This has been the case for many years and administrations.

The War Powers Act and the part of the law authorizing the FISA court are just 2 that that been claimed by presidents as non-binding on them but has never been pushed by either the congress or the president to court, with the congress saying we passed it and it is the law and the president saying it is unconstitutional.

This time it may go to court and finally be decided one way or the other but until then you have this mess.
