""Presidential powers often change based on laws that have been passed by Congress and signed by the President. For example, the "War Powers Act" now limits the president's authority to deploy troops into combat zones for no more than 90 days without congressional approval. Prior to that law being passed there was no time limit.
Same goes for FISA. Digging up pre-FISA case law cites is fairly meaningless, they have little or no effect on the current lawful interpretations and/or the constitutionality of the activities currently being discussed. """
Many laws have been passed and signed that the president has stated at the time was unconstitutional and did not apply. This has been the case for many years and administrations.
The War Powers Act and the part of the law authorizing the FISA court are just 2 that that been claimed by presidents as non-binding on them but has never been pushed by either the congress or the president to court, with the congress saying we passed it and it is the law and the president saying it is unconstitutional.
This time it may go to court and finally be decided one way or the other but until then you have this mess. - Posted by: richhayes Posted on: 05/17/06 You are currently: a Guest | Members login | Terms of Use
