Sec 102. Definitions.

(5) The term `government' means the government of the United States and any agency or instrumentality thereof, the District of Columbia, any commonwealth, territory, or possession of the United States, and any State or political subdivision thereof authorized by law to conduct electronic surveillance.

NSA = electronic surveillance. All they have to do to have the program is get a USSID 18 waiver from the Atty. General, get the FBI or get any other LEO to make the original request for them, or simply have it under the guise of counter-intelligence.

I don't know why they didn't use the law against Qwest, maybe they didn't want to make a big deal of it, I don't know the reasons.
