Does it matter?
Does it matter. If they go under then obviously you are no longer a member. Since you have to pay monthly to continue to listen to the songs if Napster did go out of business then you no longer pay. So just like cancelling the service you lose the right to listen to the songs.

This is like complaining that TV station you pay to watch on Satalite goes out of business. Sure you can't watch it anymore and that's a pain but it's not like you are out any money in the deal or really lose anything. You just lose the option to purchase that service.

If you wanted to keep the songs then you should have purchased them via CD or a service like I-tunes.

Now if you purchased the music and it was covered in DRM there may be problem. If that DRM fails to work after the company you purchased it from went under then you'd be out your investment in the music.
