A judge will decide if it's fair use
And as stated in the EFF link, there are extremely compelling
arguments that it is. I note that you completely ignore my
question about search engines, which already do the exact same
thing that Google Print does, with copyrighted websites. Do you
think all search engines are violating the law, and should they be
forced to ask all website owners permission before including
them in their database? If a judge rules against GooglePrint, that
means all search engines are liable and we'll lose all of them. Is
that a good thing?

---They will not get sued over the public domain material. But
they will get sued over the copyright stuff. I really don't care
what EFF has to say about it, because they want to open
everything up. They are lawyers opining about it with the
viewpoint of everything to be accessable. You should read what
the copyright office has to say about it. What I cut and pasted for
you. The copyright office says to consult an attorney on
copyright, not an attorney on civil liberties.---

You don't think the EFF has copyright attornies on their staff?
You don't think Google consulted with copyright attornies before
starting this venture? How naive are you? You may not like the
EFF but they have already successfully defended cases like this,
cases where fair use was threatened (the JibJab.com case for
example).

---It is interesting how you said awhile back that if I reduced the
size of a photo that I would be violating copyright but if Google
does it, it is OK. I got my link from a Texas University and you
said they were covering their ass. I believe the context of that
argument was to archive Olin Mill pictures of family. I do not
have the link anymore.---

That's an excellent question, and again, a judge would need to
rule on it. Note that WalMart won't print any photo for you that
they think "looks professional" out of fear of violating copyright.
I assume the judge would look at the planned usage of the
photo and make the call based on that. In Google's case, it
certainly fits the guidelines offered for fair use. For you to take
a professional photo that someone else holds the copyright to,
and make a new print just to show off in your office, that's a
harder use to argue.

---What Google says and does are two different things. On the
copyright stuff, they should just give the title and the synopsis
like they do in Amazon. The little stuff you do read about is with
the author's permission. It is about control over what the author
wants to reveal to the public. Google takes it away from
them.---

Hate to break it to you, but Amazon shows a lot more than the
title and synopsis. They have reader reviews, tables of contents,
and in many cases a "look inside the book" search (and they
display a lot more content than Google).

And again, when you release a product into the big scary world,
you can not hope to control every aspect of how it is marketed,
how it is sold, and how it is perceived by the public. You have
no legal right whatsoever to do so.
