Why didn't they reroute the traffic via their routing protocol or did L3 and Cogent block each others subnets. Routing protocols are in place to allow reconvergence around a downed link. I'm sure that L3 and Cogent have other peer connections. BGP will simply reroute traffic through one of the other peers. An ACL could be applied to block the known subnets of the competitor which would kill the traffic but to place an ACL goes beyond billing, that's spitefull.
