Do NOT allow government in this, It's a huge mistake!!!
Look, I understand the knee jerk reaction to get the courts involved but that is a very bad idea. In order for the courts to order resumpsion of service they must first determine that it is a "vital" service. In the past this has applied to things like ordering Firemen and Policemen to work to resume a "vital" service.

The down side of this is that it creates new law, basically elevating a luxury to "vital" statis. Now is it any less "vital" to Joe Farmer 50 miles from the nearest connection? Joe Farmer would say no and demand to be connected. Is it any less "vital" to poor people unable to pay for it? Again no, if it is a "vital" public service then it is "vital" to everyone and that gets, very, VERY expensive.

Of course we then get into required service levels like that for a POTS dial tone. It took a monopoly to provide that, do we now start handing out regional monopolies to ISPs and place them under state utility boards for regulation, compliance testing, and further regulation? Do we also increase taxes to pay for this regulation or does the ISP simply attach a "regulation fee" like we see on our phone bills?

Folks, this is truly a case of "be careful what you ask for", Be very, very careful...
