I don't think you understand the problem.
All open wiring functions as an antenna and causes interference. Just take any AM radio near a power line and you will get plenty of noise. But there are ways to eliminate the problem. One of course is by way of shielding. And, believe it or not, in some cases this could be practical with BPL. In an urban area for instance where most facilities are underground in conduit, interference problems would be greatly reduced. But another way is by reducing signal power. The problem then becomes capturing that signal that is deeply buried under a massive 60hz native power harmonic. And of course there are other ways of reducing/eliminating interference by manipulating carrier frequencies and transmission methods etc. But the problem is not insolvable. It is purely a technical challenge unlike piracy which involves a constanly evolving human factor. And most problems which are purely technical eventually get solved if enough money gets thrown their way. There will be all sorts of embarrassing failures and flakey people involved along the way, but eventually and likely soon, the major problems will be sufficiently solved and this technology will be deployed on a large scale. There is plenty of demand for the service and the utility companies are much in need of a boost in their revenues since electrical distribution is a costly proposition and ratepayers in many areas are in a bad mood.
