Assuming that BPL providers will abide by the most significant aspect of Part 15 (must not cause interference) is probably wishfull thinking. Also, imagine the situation where the system is causing interference and 15,000 users are going to be shut down because "the HAMs" complained about interference. It's a situation ripe for disaster.

I find it curious that BPL is being built primarily where broadband services are already available--in urban and sub-urban areas. As such, it's not a matter of getting broadband services to people who can't get it, it's a matter of another player wanting to grab market share with a new twist.

As for rural distribution to service people who can't otherwise get broadband (since of course there's power lines nearly everywhere), which has been used as a leader for BPL, the problems multiply when trying to service those areas. Needless to say, it's a lame argument in support of BPL and is testified to by the lack of rural BPL trials.

My real problem with BPL, however, is that it constitutes a dilution of FCC authority to regulate radio spectrum. One might look at this and correctly assume that it's a precursor to additional use of most other allocated spectrum. Look for your noise floor to rise across the board in the future. My guess is that interference pain threshold of the bulk of spectrum users will be the only limiting factor. Of course by then it may be too late.
