It could be considered theft
The scenario that you gave is a good example of why it should not be considered theft, but what about those who know they are getting on someone else's access point, that is theft! What about the two neighbors who go together and one gets DSL and they use an access point to share the connection between the 2 houses? Wouldn't that be considered theft also since they signed a contract? And as for the analogy of someone coming into your house to refute your not theft claim, no one is going to accidentally come into your house claiming they thought they were going into their own house!
