Yes, there is clearly a big difference between breaking an ISP's
terms of service, and breaking the law. One gets your service
terminated, the other gets you thrown in jail.

Which leads to the question--if you're broadcasting an open
network into public space, aren't you inviting others to join in?
Maybe not. But if my computer connects to the network and
asks for permission to join, and your computer gives that
permission (which is what's happening here), isn't that the same
as an invitation?
