This is all moot of course because the signal could be considered a 'broadcast' not a 'communication' and therefore it is 'received' and not 'intercepted'.
Unfortunately, Congress decreed in that same 1986 law that Physics is to be ignored and that certain signals - cellphone for example - are to be considered 'communications', not broadcast, in direct contravention of the Laws of Electromagnatism. So we will have to wait for clarification on this one as well.
