Interesting question arises -
If the person doing the unauthorized access had to break a key to gain that access, then it is easy to see where a crime has been committed. If a "clear" signal is being intercepted (private or not) in a public place (the street) then what do you do? You are not authorized to be there, but then you are not taking any security precatuions and the signal is indeed "public". The only thing to go on is intent.
