In keeping with...
...my usual practice of admitting when I don't know something. I will say at this juncture that I have no idea how much sway indivdual cities have over telcos and cable companies in the US.

However - whatever regulatory hurdles they have to surmount, would those hurdles not apply to a municipally owned entity?
From reading the article it did not seem like municipal regulations were the reason that private providers were not meeting the need that the cities saw. Instead it seemed like it simply wasn't profitable for them.
Choice is a tricky issue and in this type of endeavour the way choice is presented can be largely philosophical.

The tale of the car dealer was telling, it was worth his municipality providing him with broadband even though it may have been a loss making proposition in the first instance, politically the saving of 70 jobs was a non-brainer. It was not profitable for a private company, I did not see any complaint of regulatory constraints.

At the end of the day I guess it boils down to trust and necessity.
IF you think it is a necessity for all citizens to have access to broadband connectivity...

who do you trust to provide it?
