Small correction
While almost all you wrote is true, and I agree with your opinion, a little hard truth never hurt: "They are primarily from foreign (often Asian or S. American servers), and rarely those of european or US providers" is just not true. Approximately 40% (I have the exact numbers at work) of phishing attacks come from the U.S. alone. While I don't recall the numbers for the other countries, your assesment in general still stands true. Even If the US were to pass all kinds of laws, and get American ISP's in order (which they're NOT), there would still be no way to enforce them on the other 60% (or so) of attackers.
