First I have to agree with a previous poster, computers don't give evidence, they ARE evidence.

Can computers survive cross examination? Depends on your attorney. If the defendant has Gates Money no evidence matters. On the other hand if your indigent with an overworked public defender evidence retrieved from a public library terminal will do you in, even if you didn't touch the terminal, ever.

It's not till Barrett gets deep into his article that Barrett states the obvious, the computer needs examined and examined well. The machines pedigree needs established.

Let's take a short look at the 'System'. A large part of Law Enforcements function is to feed the Prosecutor winnable cases (thus justifying LEs existence) and it's the job of the prosecutor to win those cases (thus justifying the Judicial Systems existence). No arrests, no prosecutions, the whole judicial system from the LEO upward looks ineffective.

Can evidence gleaned from a machine be trusted? Once again it comes down to: can the people using the evidence derived from the machine be trusted?

Not always.
