I think terrorists and spies would use BitTorrent
BitTorrent is a semi-private distributed FTP product that has many third-party clients that make behave more as a search-less P2P (file links only) network but can still operate BitTorrent under its distributed-FTP intention, and add very strong (probably illegal) encryption to it as well.

I know Carnivore can't handle much for compression algrithms and even simple www sometimes uses on-the-fly gzip. I think thats why the FBI outsources most of their monitoring. Encrypted private BitTorrent trackers are still un-sniffable.

They just look for hotwords in various patterns and put it in their way-backlogged (especialy if it isn't in english) investigation queue. I still think this sniffing is against the 4th amendmant (I think thats the search and siezure one).

The whole safety/national security vs. freedom thing is well represented in Master of Orion 3 as the 'opressometer'. Higher opressometers hamper freedoms in favor of national security but also is major factor in the increase the HFOG (heavy foot of government) which creates opression and inefficiency without any benefit in return.
