It does happen though
Recall the news article a few months back about the car-jacker that won in court during a case which he sued the owner of the car he stole for having pet hair on the seats and he had a bad allergic reaction. And another case in which a burglar won in court for getting maced while he was breaking into a home. There is even a case in which a thief won in court for having his image displayed without his consent after he stole from a local supermarket bank. Reality is crazy these days.
