Let me see if I understand you correctly.

Most users do not know how to protect their data, so Microsoft should be liable, if they lose it.

Most users do not have correct behavior on the Internet, so Microsoft should, again, be responsible for keeping them from getting infected or infested with viruses and spyware.

The fact is, there has not been a single virus to date, that the patch to prevent infection did not already exist. Hackers simply reverse engineer the patch to create the virus. Keeping current on updates solves that problem. As for spyware, users typically, blindly agree to the EULA, before installing them (except for malware) and Microsoft is trying to do something about it, with this very product we are talking about. They purchased the technology from Giant, and they are giving it away. They simply asked for you not to sue them, if you didn't back up your data.
