Who is responsible for protecting your data?
It is everyone's own responsibility to backup and protect their own data. I can't imagine installing a piece of software, let alone "beta" software, without ensuring that my data was protected. There are many events or actions that can cause data loss. Microsoft does test all software internally before offering it to the public, but it is not possible to test every combination of hardware and software concievable.

Furthermore, regression testing of applications in each unique corporate environment before mass deployment is basic due dilligence.

Holding Microsoft liable for your own inability to protect your data sounds like passing the buck to me. It is a sad statement that Microsoft has had to include this in their EULA, because it means that there are people out there that would actually pursue such a frivolous law suit.
