Victims or lazy people?
First of all, I do have a problem with calling every one of those online a victim if they get a virus or download malware. It is your responsibility as a user to do the right thing and perhaps even more important not to do the wrong thing. If you want to use Windows, then you have to be careful about what you click on. Even if you have OS X or Linux, it is still a user's responsibility to not do anything that continues the proliferation of viruses to other users. Now, if we wanted to put the onus on any other entity than the users, perhaps we should be pointing at Microsoft and requiring them to produce a more secure product.

I have no problem with ISPs warning a user that they must get rid of a virus or malware on their machine in order to stay online. If they get two warnings over a week and still nothing changes, they get removed from accessibility. I think ALL ISPs should do this.

Now, spam, that's another issue altogether. Yes, the nation should get some sort of spam police that can EFFECTIVELY reduce spam coming into the country and get rid of all that is originating in the US. Some studies have shown that well over half of the spam originates within the US. The press and many users seem to think it's coming from overseas, where we have little or no control over it. But if these studies are true, we definitely should do whatever it takes to stop it from happening. And if that means kicking people off their ISPs because they refuse to get rid of malware on their machine, then so be it.

Since when has using the internet been a Right? It's a service that you pay to use, but you also should be agreeing to use it responsibly. If ISPs are too chicken to put directives into their service agreements and living by them, then maybe Congress should make it a law that they do. It's another example of an industry that have every opportunity to police itself, but refusing to do so because it makes them too much money not to. So, let Congress do it. Then we'll see whose complaining. It won't be the users. It will be the ISPs complaining that the rules are too restrictive or expensive to implement. But if they don't want it to happen, then they should start taking responsibility for their services.
