I don't see how there could be an anti-trust issue.
A self fixing OS isn't anti-trust.

If you make a self-screwing screw, can screwdriver makers claim anti-trust? If a car is given the ability to run without motor oil, can oil makers claim anti-trust? If you could make a wheel rim of a car attach and detach with no tire iron needed, do tire iron makers cry anti-trust? If you eliminate the need for an additional maintenance tool, it's not anti-trust.

IE was considered anti-trust because a bundled HTML renderer is not a maintenance issue. MS tries to claim both that and a media player are necessary to maintain an OS. And while that may be true of future OSes, it's been shown that they are not necessary for the current Windows OSes. However, seeing as spyware directly threatens an OS, it shouldn't prove difficult to show anti-spyware should be considered a necessary maintenance tool in a modern OS.

Anyway if IE, WMP, and the firewall can be bundled so long as you are given the option to not use it, I don't see how you can't do the same for spyware.
