In answer to your question; "would you stop someone from jaywalking by killing him" you have made a common if not gross error in logical reasoning. Your particular falacy is called a "False Analogy". You have attempted to compare two events which have disparate outcomes/conclusions. A Human Life is non-refundable once taken away. These spammers/criminals can always be reborn with another scam, another host, another ISP, somewhere out there in this big expanse. One would try to stop a Jaywalker by talking, yelling or even holding onto him(theoritically) or pointing him out to the authorities. But even though this answer seems correct, it becomes clear that the jaywalker is possibly only doing harm to himself and not to others. Thus in conclusion your "Jaywalking" anology is deemed a complete Falacious anologous argument.
