The comparison is...
...industry average for comercial programs, of similar size, on which the product has been tested.

The first report specifically stated that they did not and could not compare the Linux kernel code with that of Windows as they had no access to it but they did have acces to similarly sized, typical commercial code from their clients to compare with. The report also said that if Windows is typical then it would have approximately x amount of flaws, where x is a very high number, based on the number of lines of code. That report also went on to say that MS uses similar flaw-catching tools on their own code so it cannot be assumed that they have that many flaws in their shipped products.

That first report also said that it had been carrying on that research for many years and that the reserch concluded before the final release of kernel 2.6 and that the problems found were being addressed by the developers as the reserch continued. THerefore, the final release of kernel 2.6 had much fewer bugs than the report said was found.
