A daemon in Unix is pretty much the same as a Service in Windows. Regular users in Windows cannot install Services.
Regardless, I don't believe that most spyware runs as a service. The advantage of a daemon/service is that it runs when no one is logged on which is useless to spyware. In most cases the spyware is setup to run every time a user logs on or, even easier, it is simply piggybacked "functionality" of another program like nifty free toolbars.
