Sometimes I try a grape before buying
To check and see if the grapes are ripe enough I try one, then take the bunch if they are. Alright, I admit it, sometimes I have a grape before buying even though I know they're ripe. Yes, I am stealing a grape. By your logic, I shouldn't make it out of the store alive.

Because customer relations are important, the store is willing to tolerate that kind of small loss.

The RIAA is willing to take people into court and otherwise do as much damage as possible, even if they have to overcome Constitutional protections. (And getting Congress to give the RIAA more investigative power than the FBI didn't come cheap. That's heavy campaign contributions and informational dinners for years.)

A grocery store overlooks minor pilferage. The RIAA, which had no proof they lost a nickel to file swapping, will use any means short of violence to attack people who are buyers of their products and who download music on the internet.

Come on, is that rational behavior?
