This really equals them cheating the legal system.: In the real world if you go in to a store and shoplift a candy bar and get caught, the police arrest you and give you a court date. You then will get fined or do some community service if you are found guilty. But the presumption is that you are innocent until proven guilty. If we look at the file sharing thing the one difference is you aren't really taking something from someone, you are giving away something that has been deemed illegal to give away. So what should happen is, if you are caught doing this you should be charged and given a court date so that you can be proven guilty. The RIAA doesn't want to do this because one it wouldn't make them any money, two it would take a long time and they might loose. What they are basically doing is using the power of their big bank account to scare people with small bank accounts. It's a kind of vigilante justice, like if the before mentioned store owner didn't call the cops but instead showed up at the thief's house with some friends and said pay me or I'll break your knee caps. Yes the thief was wrong to steal from the store but does that give the store owner freedom to threaten the thief? the RIAA isn't threatening people with physical harm, they are threatening them with financial harm.
