Tax the company using spammers
Tax the HELL out using SPAM to advertise a product and if you don't declare it of to prison you go for tax evasion. Make the tax so cost prohibitive that no one in thier right mind would SPAM another person. In this way you don't outlaw spamming so there is no rights to worry about infringing as they are free to SPAM away all they want.
