How is it different?
For starters, OSS and related s/w you PAYED NO MONEY to obtain or you were charged the cost of media it came on. Would it be reasonable to SUE for damages people who gave you very valuable s/w for free?

On the other hand, MS SELLS s/w at very high premium. The fact that they put the EULA disclaimer right UP FORNT tells me that they have VERY LITTLE confidence on the quality of their products.

There ARE quality standards for consumer products and s/w MUST fall into a similiar legal framework. When you buy tires you expect them to be able to carry the load and the stresses of the vehicles they werer claimed they were designed for.

You need specs and a measure of quality of the product MEETING the specs.

Anyway, I probably shouldn't spent so much time spelling out the obvious to you. Do you leave in some other planet or are you a person isolated in a cave?
