You don't have to sue for only crimes
You can sue for anything you. I can sue you because I think you look ugly. I surely won't win but I can spend hoards of cash on lawyers if I was stupid enough and they have you counter sue me for expenses.

In this case you could sue for negligence. Companies like the give the expectation of privacy and 3 lapse in security in 1 year. Well that's not excusable. This company should be spanked unless they can bring evidence forward showing due diligence.
