For a crime you need means, motive and opportunity. For most terrorists, I can easily see their motives. When we cannot see their motives, they eventually make it clear in messages through the press. Means and opportunity are, in the vein of terrorism and cybercrime, moot points.
Catch most terrorists and you will need no further investigation for means, motive and opportunity. Catch most virus writers and you will have a tough time proving motive.
This begs the question: harmfull prank (reckless endangerment), misdemeanor or fellony? You cannot compare your "living in mama's bacement" virus writer to a terrorists.
Now some other cybercriminals have their equal in life such as the identity theives and embezlers. Their may even be those who will try to use viruses to pull down power grids or crash planes, trains and automobiles who are terrorists but it is a far strech to say, "If you code a virus, you are a terrorist."
If I had the choice of living in a world without virus coders or a world without rapists, I'll take the world without rapists. I can get coders to make my Gentoo hardened against all they will throw at me since MS isn't helping. At best, they will force MS to make a better product to compete in a war-torn Internet. At worst, they cause people to die and probably get no more than man two.
Although dead peole is always a bad thing, it doesn't make them terrorists. Timothy Mcveigh. Terry Nichols. Eric Rudolf. They are terrorists. Can you see the difference?
