You are wrong. There is no law in the U.S. against using a encrypted phone. If you can afford them you can use them, just like you can use encryption programs on your computer if you wish.

Of course if you do decide to get and use one (or actually 2, as both caller and callee have to have one), the government might just decide to look at you closer to see why you think you need one, but you can buy and use them.
