The article was questioning whether hiring hackers (and by extension in this article, virus writers) is a prudent business decision. Whether one could win a suit against MS as an attractive nuisance or could lessen one's own civil liability through a defense of contributory negligence is not at issue.

I, for one, would consider the risks to my company's assets and reputation (an intangible asset) to be too great to warrant hiring anyone who has been convicted of breaking into someone else's system(s) or of writing a virus released into the wild. I wouldn't care what OS they cracked, what their skill level was or whether they appeared truly contrite over their past actions. Their presence on my payroll would present a risk I am not prepared to assume.

You have yet in any of your postings to answer the very question posited in the article...would you or would you not hire such an individual? Why or why not?
