Hacking isn't about the tech
It about the social element. They know that. Much like an ex-drug dealer can spot a drug deal going on even if the drugs being sold are drugs he's never seen.

Also what about the Hacker that just gets fines with community service and no actual jail time. What if the jail time is only 3-6 month. The knowledge is not lost.

On top of that the core concepts all remain. You can get up to speed in month of study instead.

Personally If I were to hire someone with a history of illegal activity using computers I'd not give them a job with any responsiblity and they would be watched like a hawk. Then if that produces value I'd keep them and if not turf them.
