He was talking about Microsoft backing out on the deal to an informant and comparing it to the deals that prosecuters give in plea bargins. So of course the prosecution didn't promise anything, there is no court case. It was just a comparison of tactics used in court and why prosecutors stick to deals made in plea bargins as compared to Microsoft offering a reward and not living up to having the same type of consequences. If Microsoft doesn't live up to the bargin they will get no informants stepping forward again.
