If this kid pretended to be E-Bay then he misrepresented himself. That falls in the realms of fraud. Much like if I take your credit card and charge items to it pretending to be you.

Now if this kid made no attempt to mislead or such then he's free as bird. Kind of like if I ask if I can punch you and if you say I can then you can't charge me with assualt when I punch you.

Kind of stupid but there are stupid people out there that will authorize you to hit them just as there are stupid people that will take orders from people who the should know don't have the authority to give the order.
