For your example to work, ownership must be administered by a third party. Let's say the Department of Ownership and Related Knowledge (DORK) holds all records of ownership. If I go to the DORK and request that your house be made my house, and I didn't suggest that I was you or had your permission, would I be at fault if the DORK gave it to me? Only if there are laws already in place that say that I can't ask for something that isn't mine.
In most cases where a domain is transferred without the owner's permission, it happens as a result of the submission of forged documents, or failure to renew the domain in a timely fshion.
